Law on requirements for organic production and labeling of organic products enters into force in August this year
On August 2, 2019, the Law of Ukraine “On Basic Principles and Requirements for Organic Production, Circulation and Labeling of Organic Products” enters into force, which takes into account European experience in implementing the public-private control system for the organic sector of agricultural production.
According to this Law, state control (supervision) in the field of organic production, circulation and labeling of organic products by operators is carried out by State Service of Ukraine on Food Safety and Consumer Protection. Its authority in the field of organic production, circulation and labeling of organic products also includes the development and approval of a state logo for organic produce, promoting the development of the organic produce market, maintaining the Register of Organic Market Operators, the Register of Organic Seeds and Planting Material and the Register of Certification Bodies, as well as ensuring the openness and accessibility of these registers.
According to Article 27 of the Law, organic production and / or circulation of organic products in Ukraine is subject to certification. Certification is not only subject to the movement, storage and sale of labeled organic products.
The provisions of the Law also contain requirements for the certification of organic production and circulation of organic products, set requirements for certification bodies, their functions and responsibilities. The certification of organic production is vested in accredited certification bodies.
Certification of organic production and / or circulation of organic products is carried out with the annual mandatory field inspection by the certification body in order to determine the conformity of the production process and its circulation with the requirements of the legislation in the field of organic production.
Pursuant to Article 27 of the Law, a person who intends to switch to organic production or to market organic produce may choose any accredited body and enter into a certification contract with him. In the case of certification of organic production according to norms and standards recognized in foreign countries or international organizations, a person has the right to conclude an additional agreement with a foreign certification body.
Following the verification of compliance of all stages of production and circulation of organic production with the requirements of the legislation in the field of organic production, circulation and labeling of organic products, the certification body makes a reasoned decision to issue or refuse to issue a certificate.
The certificate is valid for 15 months from the date of issue.
A certificate of production and / or circulation of organic products under other legislation than legislation Ukraine recognized in Ukraine to import or export of such products if it is entered in the List of foreign certification bodies.
For the entry of the foreign certification body into the List of foreign certification bodies, the importer or exporter submits an application to the central executive body, which implements the state policy in the field of safety and certain indicators of food quality. The application shall be submitted in any form.
The Law also provides for the responsibility for violation of the norms in the field of organic production, circulation and labeling of organic products in the form of a fine, including the responsibility for non-compliance with the law and certification bodies.
